The Commissioner for Environmental Information, Peter Tyndall, has referred a question of law arising in an appeal to the High Court for determination, under article 12(9)(a) of the AIE Regulations. The Commissioner seeks the assistance of the High Court on the interpretation of articles 8(a)(iv) and 9(1)(c) of the AIE Regulations, to the extent that they involve an interplay (if any) with the Freedom of Information Act 2014.
